Dues Settlement

The Public Sector Labour Relations Act (PSLRA) requires the deduction and remittance of dues from the monthly wages and salary of each employee in a public sector bargaining unit. The PEA and the Employer are parties to the Seventeenth Main and Subsidiary Agreements, which reiterates the requirement for the Employer to deduct membership dues from the salary of each member and remit it to the PEA. On July 14, 2023, Bill 5 came into force and placed certain Government Lawyers into the PEA’s Government Licensed Professionals (GLP) bargaining unit. However, the Employer did not start deducting and remitting dues to the PEA until November 19, 2023. The PEA filed a grievance alleging that the Employer had failed to deduct and remit dues from the salaries of the Government Lawyers to the PEA as required by the Collective Agreement and the PSLRA.

We are happy to report that the Employer and PEA have reached an agreement to resolve the grievance. The Employer will provide payment to the PEA of the dues it should have deducted from Government Lawyers in the GLP bargaining unit from July 14, 2023 to November 18, 2023. The Employer has agreed that it will not retroactively deduct PEA dues from Government Lawyers in the GLP bargaining unit for that period.
